Urge of Builders to The Government of Rajasthan to reduce the stamp duty in the upcoming budget.

 

In a meeting that took place on Friday for recommendation on the Budget of 2022-23, Credai-Rajasthan a Leading real estate industry body urged the government to reorganize the stamp duty structure.

“The continuous rise in the DLC rates and high stamp duty has resulted in the rise of property prices,” said Dhirendra Madan, President of Credai-Rajasthan.

Madan also stated “Almost all the real estate developers buy land to mass build housing units to be sold to potential buyers. But the continuous increase in the prices of raw materials has made it very hard to decrease the price for the buyers. That’s why we want the government to lower the stamp duty and registration prices to 50%”.

Including surcharge, the stamp duty charged on housing is among the highest in the country at 8.80%. The affordability of housing for the common people is being affected by the continuous rise in the DLC rates.

In a statement made by Rajendra Singh Panchar, the anomaly in the stamp duty on the warehouses was also brought to light. Warehouses are supposed to be permitted as MSME industrial units by UDH as they are governed under the Rajasthan Investment Promotion Scheme-2019. But they are charged as Industrial units when it comes to stamp duty which attracts higher taxes.

According to a mechanism proposed by Panchar to allow the laborers to stay and work “Government can provide land on concessional rates to the agencies which can build facilities for the laborers which will follow a rental system at an affordable rate.” Madan also said that there is no reason to ask the people residing in the societies for an upfront payment of developmental fee on a sq. ft basis rather they should be charged a monthly fee like every common household.

The government has provided setback relaxation on the construction of affordable multistory housing on private lands and has also provided relaxation on granting approvals. According to one of the officials  “For Buildings of height up to 45 Meters, the developers will have a setbackof 6 meters and there will be no need to seek permission from the government. Similarly, the Urban Improvement Trusts and Development Authorities can provide height clearance without seeking higher approval of up to 30 Meters and 40 Meters respectively.

According to the orders passed on May 31st of 2017, the registered were authorized to approve the projects. Whereas in the orders passed on July 17th of 2018, the rights for height clearance were given to Urban Improvement Trusts and Development Authorities which resulted in the process being stalled.

The recent orders have made it clear that the projects approved between 2017 and 2018 will not require the permission of the state government again.

The collectors of Rajsamand and Pali have been instructed by the bench comprising of Justice Sandeep Mehta and Justice Vinod Kumar Bharwani to ensure the compliance of the stay order. The court order dated 18th of January Mentions “All Construction activities being undertaken within 1000 meters from the boundary of Kumbhalgarh Forest Reserve shall remain stayed”. The order also reads, “The principal secretary, department of tourism and district collector, Rajsamand and Pali shall be personally responsible for ensuring compliance of this order.”



An Advocate, Rituraj Singh has filed a Public Interest Litigation and mentions that as per the Rajasthan tourism policy of 2020, people can operate up to 20-room guest houses without converting their properties into commercial ones. Because of this policy, several hotels come within 1Km radius of the protected area. The PIL mentions that the forest department issued an order dated 31st March 2015 regarding the prohibition of commercial and industrial activities within a 1Km radius of the reserve.

Revenue authorities were also directed not to convert the lands within the 1000-meter radius of Ranthambhore, Sariska, Kumbhalgarh Wildlife Reserve, and Jawai leopard conservation reserve.


The PIL Reads, “A 20-Room guest house is purely a commercial activity, and as per the orders of the forest department it should be prohibited but since the department of tourisms does not consider them a commercial activity there are a lot of them within the prohibited radius of 1Km.”

Rituraj Singh also claimed that the National Tiger Conservation Authority published a feasibility report to declare the Todgarh Raoli and Kumbhalgarh Wildlife sanctuary as a potential tiger reserve.

The report specifically mentioned that the sanctuaries are in a form of thin stretch and it’s imperative to add more areas to declare them a tiger reserve. 

Singh also added “With more land falling in the scope of construction around the reserves, the forest department will fall short for any further broadening.”

The project was under the supervision of Ludhiana Improvement Trust on behalf of Municipal Corporation and it was completed just a month ago. This so-called Recarpeting of the road has supposedly involved an expenditure of 2.27 Crore. But the quality of the construction does not live up to the expenditure and has loose gravel patches, depressions and peeled of upper layers all over the Recarpeted stretch.



A Social Activist from the city and the secretary of the Council of RTI Activists, Arvind Sharma, claims that he has cautioned the LIT before about the use of substandard material and work being carried out at night in extreme weather conditions. He also claims to have lodged a formal complaint with the Director, Local Bodies, Punjab, and Chief Vigilance Officer of Local Government Department, Punjab for a thorough probe into the project about use of bad material and insincere workmanship.




Arvind Sharma claimed that the complaint was brought up to Senior LIT officials many a times but they were unable to take any actions due their bad affinity with the contractors and so they were able to get away with construction of road in posh area of the town which could not stand the trials of time and weather even for a month. Mr. Sharma has been demanding a probe in the matter and action to taken regarding the matter.
